Zero Tolerance Policy (ZTP) / Spam Policy

  • "Spam" — Any unsolicited commercial email (UCE), unsolicited bulk email (UBE), mass messaging, or junk communication sent without the prior consent of the recipient or in the absence of an existing business relationship.
  • "Cloudy24" / "We" — Cloudy24.com and its operators.
  • "Customer" / "You" — Any individual or entity using Cloudy24 services.

The following are considered spam and are strictly prohibited on Cloudy24 infrastructure:

  • Unsolicited Commercial Email (UCE) or Unsolicited Bulk Email (UBE) sent to recipients without explicit prior consent.
  • Bulk promotional messages sent via email, SMS, WhatsApp, Telegram, or any other messaging platform without the recipient's opt-in consent.
  • Spamvertising — sending unsolicited bulk messages to promote a website or service hosted on Cloudy24, even if transmitted through a third-party server or service.
  • Flooding of message boards, forums, comment sections, or mailing lists with off-topic or promotional content.
  • Use of purchased, scraped, or rented email/phone lists for bulk outreach.
  • Bulk messages with "opt-out" instructions only — these are not permitted as a substitute for prior opt-in consent.
  • Any form of unauthorized bulk messaging, including via IRC, instant messaging apps, push notifications, or automated bots.
  • You are solely responsible for all communications sent from your account or using your hosted services — including those sent by employees, contractors, advertising agencies, or sub-lessees acting on your behalf.
  • You must ensure that all email lists you use are fully opt-in and that you can provide verifiable proof of consent if challenged.
  • Contact forms on your website must use a single 'From' email address belonging to your domain to avoid blacklisting.
  • You must comply with TRAI's Telecom Commercial Communications Customer Preference Regulations, 2018 (DND / NDNC regulations) for any SMS or telemarketing communications.
  • Mass email is only permitted to active customers who purchased a service within the past 12 months or who have explicitly opted in to your mailing list.

Cloudy24's enforcement processes are automated. Upon receipt of a verified spam complaint, the following actions will be taken immediately and without prior notice:

  • First offence: The website, email service, or server associated with the spam will be suspended for 48–72 hours.
  • Repeat offence: The hosting account, email boxes, and all associated services will be permanently terminated without refund.
  • Domain action: The domain name associated with the spam activity may be suspended at the registrar level if it is registered through Cloudy24 or a partner registrar.
  • Blacklist submission: The offending domain(s) and IP address(es) will be submitted to industry anti-spam blacklist databases, which may render them unusable across other providers as well.
  • Legal referral: Serious violations may be reported to law enforcement and relevant authorities under applicable Indian law.

If your account has been suspended due to a spam complaint and you believe it was in error, contact legal [at] cloudy24 [dot] net with the following details:

  • A copy of the last email or message sent in bulk.
  • The IP address of the SMTP server used.
  • Proof of recipient consent (opt-in records).

Note: Without these details, the appeal will not be processed.

This policy is governed by the laws of India. Relevant legislation includes:

  • Information Technology Act, 2000 — Sections 43, 66, and 66A (as applicable) governing unauthorized access and electronic messaging abuse.
  • TRAI Telecom Commercial Communications Customer Preference Regulations, 2018 — Governing unsolicited commercial calls and SMS (DND / NDNC framework).
  • Indian Penal Code / Bharatiya Nyaya Sanhita — For fraudulent or criminal communications sent via our platform.

This policy is without prejudice to any other rights or remedies available to Cloudy24 under applicable law. There is one simple rule: DO NOT SPAM. If you are unsure whether your communication qualifies as spam, assume that it does and stop immediately.
